By using aspiretravelclub.co.uk/ (the “Site”) you are agreeing to the terms and conditions of the Site.

 

It is important that you review these terms and conditions from time to time. Notifications of any changes and updates made to these terms will be published here.  

 

1. These Terms

1.1. By using our Site, you confirm that you accept these terms of service and that you agree to comply with them. If you do not agree to these terms, you must not use our Site.

1.2. We amend these terms from time to time. Every time you wish to use our Site, please check these terms to ensure you understand the terms that apply at that time.

1.3. We may update and change our Site from time to time to reflect changes to our products, our users' needs and our business priorities. We will try to give you reasonable notice of any major changes.

1.4. Our Site is made available free of charge. We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

1.5. You are responsible for ensuring that all persons who access our Site through your internet connection are aware of these terms of service and other applicable terms of service, and that they comply with them.

1.6. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

 

2. Your Responsibilities

2.1. When posting or reading you agree:

2.1.1. to keep your user name and password secure at all times and to contact us immediately at editorial@travelweekly.co.uk if you have reason to believe that they may no longer be secure;

2.1.2. not to use any other user's identity to log on to the Site;

2.1.3. to accept full responsibility for any material you place on the Site;

2.1.4. only to use the Site for lawful purposes;

2.1.5. not to post defamatory, abusive, offensive, racist, sexist, threatening, vulgar, obscene, hateful or otherwise inappropriate comments, or to post comments which will constitute a criminal offence or give rise to civil liability, on the Site;

2.1.6. not to use the Site to solicit other users to become users of competitive online services, to advertise or offer to sell any goods or services for any commercial purpose, or to promote any surveys, contests or chain letters without the express written permission of the Site;

2.1.7. not to post or make available any material which is protected by copyright, trade mark or other proprietary right on Aspiretravelclub.com without the express permission of the owner of the copyright, trade mark or any other proprietary right and you will be solely liable for any damages resulting from any infringement of the above. If you believe that any materials on this website infringe your copyright or trademark, you may request that they be removed. This request must be emailed with your name, address and telephone number along with any supporting information. 2.1.8. not to upload to the Site files that contain viruses or files or programs that are designed or intended to disrupt, damage or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorised access to any data or other information in the possession of the Site or any third party, and you will be solely responsible for any damages from any claims that may arise because you posted files that caused damage to the operation of another person's software, hardware or telecommunications equipment; and

2.1.9. to evaluate for yourself the accuracy, completeness or usefulness of any opinion, advice or other content on the Site;

2.1.10. that you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

 

3. Monitoring

3.1. When users submit material to the Site it is posted automatically. If our attention is drawn to problematic material we may edit or remove any material which we deem to be inappropriate without giving reason or notice. Travelweekly.co.uk has a right but not an obligation to monitor user-posted content.

3.2. We may temporarily or permanently deny any user's access to the Site without reason or notice.

3.3. We may refer any matter to a law enforcement agency or Court of competent jurisdiction where we consider a matter is of a criminal or unlawful nature.

 

4. Public Content Posted to the Site

4.1. With respect to Content you elect to post for inclusion in publicly accessible areas of the Site, including but not limited to comments, feedback, opinions, statements or material contained in any communication with this Site, you grant the Travel Weekly Group  a world-wide, royalty free and non-exclusive license to reproduce, modify, adapt, and publish such Content. Such Content may be used without compensation at the sole discretion of The Travel Weekly Group.

 

5. Subscription Services

5.1. If you wish to become gain full access to the restricted parts of the Site, you must purchase a subscription through the Site (the “Subscription Services”).

5.2. You are entitled to purchase one subscription which will entitle one you to receive the Subscription Services on one account (a “Subscription”)

5.3. In relation to each Subscription, whether such related account is owned by you or not, you undertake that:

5.3.1. You will not authorise more than one account to receive the Subscription Services;

5.3.2. You will not allow or suffer any Subscription to be used on any more than one individual account unless it has been reassigned in its entirety to another individual account, in which case the prior account shall no longer have any right to receive the Subscription Services;

5.3.3. the account shall be protected with a secure password in order for it to receive the Subscription Services and that you shall ensure that the password for the account is kept confidential.  

5.4. We shall provide you with details of the Subscription Services on the Site which shall include, without limitation, information about the subscription fee to be paid for a Subscription (the “Subscription Fee”).

5.5. To subscribe, you must follow the steps on the relevant page of the Site and pay the applicable Subscription Fee.

5.6. You must provide us with accurate and complete information that we may request from time to time including contact details, valid credit/debit card details and other payment information. You must inform us immediately of any changes to any information you have provided us. You may be subject to additional charges for failing to provide us with correct payment information.

5.7. Payment of the Subscription Fee shall be made by you by credit/debit card or any other payment methods which we specify on the Site.

5.8. We have the right to change our Subscription Fees at any time. We will endeavour to give you one (1) month notice of any changes to our Subscription Fees. If you do not agree with the change, please cancel your subscription with us. You shall be deemed to have accepted our Subscription Fee change by continuing to use the Subscription Services.

5.9. Subscriptions for the Subscription Services shall, unless otherwise terminated by you, commence upon payment of the first Subscription Fee and shall continue for a period of 12 months commencing on the date the Subscription Fee is paid (the “Initial Subscription Period”) and, thereafter, shall automatically renew on a recurring basis for successive periods of one calendar month (each a “Renewal Subscription Period”) until cancelled by you.

5.10. The Initial Subscription Period and any subsequent Renewal Subscription Periods will constitute the Subscription Period.

5.11. You hereby authorise us to automatically charge you for the Subscription Fee using the payment information provided at the start of each Subscription Period.

5.12. If you do not wish to renew your subscription, you must cancel the Subscription Services at least 10 working days before your subscription is due for renewal. Otherwise you will be charged for the next Renewal Subscription Period.

5.13. Unless you have already downloaded any digital content, you are entitled to cancel the Subscription Services up to 14 days after the commencement of the Initial Period or any applicable Renewal Subscription Period and receive a pro-rated refund of any portion of the Subscription Fees you have not used. Where you have already downloaded digital content, you will lose your statutory right to cancel your Subscription Services.

5.14. You understand that where you cancel your subscription with us after the 14 day period has expired, although your subscription will not be renewed for the next Renewal Subscription Period, you will not be eligible for a refund, or pro-rated refund of any portion of the Subscription Fee paid for your current Subscription Period. In that case, your access to the Subscription Services shall continue under the end of your current Subscription Period.

5.15. We may terminate your access to the Subscription Services with immediate effect at any time if;

5.15.1. you breach the terms of this Agreement;

5.15.2. you fail to make any payment on its due date; or

5.15.3. for any other reason.

5.16. Where we  terminate your access to the Subscription Services for a reason other than your breach of these terms or your failure to pay, we will give you such notice as is reasonably practicable and you will be entitled to a refund of that part of any fee which relates to the unexpired Subscription Period.

 

6. Use of the Site

6.1. You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Site or any services provided via, or in relation to, our Site for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes using (or permitting, authorising or attempting the use of):

6.1.1. Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our Site or any data, content, information or services accessed via the same.

6.1.2. Any automated analytical technique aimed at analysing text and data in digital form to generate information [or develop, train, fine-tune or validate AI systems or models] which includes but is not limited to patterns, trends and correlations.

The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

6.2. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our Site in any website that is not owned by you. Our Site must not be framed on any other Site, nor may you create a link to any part of our Site other than the home page. We reserve the right to withdraw linking permission without notice.

6.3. We do not guarantee that our Site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access our Site. You should use your own virus protection software.

6.4. You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with our Site or any part of it. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site or any other equipment or network connected with our Site. You must not interfere with, damage or disrupt any software used in the provision of our Site or any equipment or network or software owned or used by any third party on which this Site relies in any way. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

 

7. Your Identity and Licence

7.1. You acknowledge that (except where explicitly stated) materials shared on the Site are not private and can be viewed by everybody  who visits Aspiretravelclub.com, that other users will be able to identify (by username) who has posted each piece of material and that the username (and any profile details they have provided) of who is logged on to the Site at any given time may be visible to all users.

7.2. You should log off the Site when you have finished posting to prevent anyone else accessing the Site and using your log-on identity. This is particularly important where other people may use the same computer as you, such as in internet cafes. If you do not log off, you may be deemed to be the person viewing or posting material unless you can prove otherwise.

7.3. We reserve the right to reveal your identity details to third parties if we believe that you may have breached any of the Terms.

7.4. For your own safety and security, we recommend that you do not disclose personal information such as your password, credit card number, home address, email address, phone number etc., on the Site.

7.5. By posting material on the Site, you grant all other users the right to obtain access to such material and to view, store and reproduce them for personal use.

 

8. Limitation of Liability and Exclusion of Warranties

8.1. You acknowledge that the author of each posting on the Site is responsible for his or her comments.

8.2. Insofar as the law permits, we shall not be liable for any loss, damage or distress incurred as a result of material posted on the Site.

8.3. We are not responsible for the accuracy, veracity or reliability of any opinion, advice or statement made on the Site and such communications shall not be considered to be reviewed, screened, monitored, edited or approved by us.

 

9. Indemnity

9.1. You acknowledge that you are responsible for any material that you post on the Site and that if you breach any of the Terms you may be personally liable to any third party that suffers harm as a result.

9.2. You agree to indemnify and keep indemnified us, our successors and assigns, our directors, trustees, officers, employees and agents from and against all liabilities, claims, losses, costs, damages and expenses including legal fees which are reasonably incurred by us should you breach any of the Terms.

9.3. The indemnity detailed in clause 7.2 includes your use of the information you read on the Site, together with any introduction or collaboration that you enter into as a result of participating in the Site.

 

10. Disclaimer

10.1. Links to other sites are accessed at your own risk and the Site accepts no liability for any linked websites. When you access another website, please understand that it is independent and the Site has no control over the content of that website. Further, a link to another website does not mean that the Site endorses or accepts any responsibility for the content or the use of such website. Users must take their own precautions to ensure that what is selected for use is free of such items as viruses and other items of a destructive nature.

10.2. To the full extent permissible by law Travel Weekly Group Limited shall have no liability for any damage or loss (including, without limitation, financial loss, loss of profits, loss of business or any indirect or consequential loss), however it arises, resulting from the use of or inability to use this website or any material appearing on it or from any action or decision taken as a result of using the website or any such material.

 

11. Advertising/Sponsorship

11.1. Inclusion of any material in advertisements or sponsors' materials on this Site  does not constitute any guarantee or endorsement as to the quality or value of any of the products advertised or any claims made for the product by the manufacturer. Any correspondence or dealings which you may have with advertisers or sponsors promoting themselves on this Site are solely between you and that party. We shall not be responsible or liable for any loss or damage of any kind incurred as a result of any such dealing or as a result of the presence of such advertisers on the Site.
